Terms of Service

These Terms of Service ("Terms") govern your use of GritForge (the "Service", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

GritForge is a workout tracking and gym management platform. It lets individuals plan and log workouts, and lets gym owners manage memberships, staff, and classes for their business.

2. Accounts

You must provide accurate information when creating an account and are responsible for activity that occurs under it. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.

3. Subscriptions and Billing (Gym Owners)

Gym owners may subscribe to a paid plan to unlock additional features. Subscriptions renew automatically each billing period until cancelled. You can cancel at any time from the Billing page; access continues until the end of the current billing period. See our Refund & Cancellation Policy for details.

4. Member Payments

Where a gym charges its members through GritForge, payments are processed by our payment processor (Stripe) and paid out to the gym's own connected account, less our platform fee. GritForge is not a party to the membership agreement between a gym and its members — that relationship, including pricing and refunds for memberships, is between the gym and its members.

5. Acceptable Use

You agree not to misuse the Service — including attempting to access accounts or data that aren't yours, interfering with the Service's operation, probing or scanning it for vulnerabilities without authorization, uploading malicious code, scraping data at scale, or using it for any unlawful purpose.

6. Your Content

You retain ownership of the content you submit to the Service — workout logs, programs, goals, gym photos, and similar data ("Your Content"). By submitting it, you grant us a limited license to host, store, and display Your Content back to you (and, where you choose to make it visible — e.g. a gym's public photos or class listings — to other users) solely to operate and improve the Service. You're responsible for having the rights to anything you upload, including gym photos, and for not uploading content that infringes someone else's rights or is unlawful.

7. Our Intellectual Property

The Service itself — its software, design, and the GritForge name and logo — belongs to us or our licensors and is protected by intellectual property law. These Terms don't grant you any rights to our trademarks or branding beyond what's needed to use the Service normally.

8. Third-Party Services

We rely on third-party providers to operate the Service — for example, Stripe for payment processing and payouts, and an email provider for account and notification emails. Your use of payment features may also be subject to those providers' own terms. We're not responsible for the acts or omissions of third-party providers, though we choose them carefully.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms, pose a security risk, or where required by law. Sections of these Terms that by their nature should survive termination (e.g. Intellectual Property, Disclaimers, Limitation of Liability, Indemnification) will continue to apply.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. GritForge is not a fitness or medical professional — workout information provided through the Service is not medical advice. Consult a qualified professional before beginning any exercise program. We don't guarantee the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, GritForge is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us, if any, in the twelve months before the claim arose.

12. Indemnification

You agree to indemnify and hold GritForge harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

13. Dispute Resolution

If a dispute arises, we'd like the chance to resolve it informally first — contact us before filing a claim. If it can't be resolved informally, the courts of Scotland have exclusive jurisdiction over any dispute arising from these Terms or your use of the Service.

14. Changes to These Terms

We may update these Terms from time to time. We'll post the updated version here with a new "Last updated" date. Continuing to use the Service after changes take effect means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of Scotland, without regard to conflict-of-law rules.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms are the entire agreement between you and us regarding the Service, superseding any prior agreements on the same subject. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond reasonable control.
